Terms & Conditions

1. Definitions

  • “Business” means Bury Plumbing Pty Ltd, its employees, agents, and subcontractors.
  • “Customer” refers to the person or entity engaging the Business to perform plumbing services.
  • “Goods” means materials, parts, fixtures, or equipment supplied.
  • “Services” means all plumbing-related work carried out by the Business.


2. Quotes and Deposits

  • All quotes provided are valid for 30 days from the date of issue. The Business may amend an unsigned quote after a period of 30 days to consider any rise or fall in the cost of performing works. The Customer shall be notified of such amendment as soon as practical thereafter. No work will be carried out until such time as the customer agrees to the amendment of the quote.
  • A 30% deposit is required upon acceptance of the quote to secure the booking and materials.
  • The remaining balance is payable in accordance with the payment terms below.
  • Variations or additional work not included in the original quote will be invoiced separately.


3. Payment Terms

  • All invoices are due for payment within 7 days of the invoice date, unless otherwise agreed in writing.
  • A late fee of $15 will apply if payment is not received by the due date.
  • A further 5% interest per month (compounded monthly) will accrue on any outstanding balance after the initial late fee.
  • All costs associated with debt recovery will be added to the outstanding amount owed by the Customer.
  • The Business accepts payments via bank transfer, EFTPOS – Visa & Mastercard. A 1.5% surcharge will be applied to all EFTPOS transactions. The surcharge payment amount will be disclosed prior to processing payment. There is no surcharge for payments made by direct bank transfer (EFT).


4. Warranties

  • The Business warrants all workmanship for a period of 12 months from the date of completion, unless otherwise stated in writing.
  • No warranty is provided for any goods, parts, or fixtures supplied by the Customer.
  • Where goods are supplied by the Business, any manufacturer warranty applies as per the manufacturer’s terms and conditions.
  • Warranty claims must be made in writing within the warranty period and are subject to inspection by the Business.
  • Warranty is void if:
  • Goods are misused, tampered with, or improperly maintained.
  • Plumbing systems are altered by a third party without written consent.
  • The Customer fails to pay for the services in full.

 

5. Defects

The Client shall inspect the Goods on installation and shall within seven (7) days notify the Contractor in writing (by email or text message) of any alleged defects. The Client shall afford the Contractor an opportunity to inspect the Goods within a reasonable time following installation if the Client believes the Goods are defective or fail to match the description in the Quote. If the Client shall fail to comply with these provisions the Goods shall be conclusively presumed to be in accordance with these Terms and Conditions and free from any damage

 

5. Customer Obligations

The Customer agrees to:

  • Provide clear and safe access to the property and work area.
  • Ensure all necessary permissions, permits, and approvals are obtained prior to commencement of work.
  • Disclose all relevant information about existing plumbing infrastructure or known issues.
  • Ensure pets and children are kept away from work areas for safety.
  • Not interfere with or direct plumbing staff without prior approval.
  • Pay invoices in full and on time, including variations or additional work agreed upon.
  • Accept responsibility for any additional costs caused by inaccurate information or unforeseen site conditions

6. Cancellations/Missed Appointments and Rescheduling

  • Cancellations made with less than 24 hours’ notice may forfeit the deposit or incur a call-out fee.
  • Rescheduling must be requested with reasonable notice and is subject to availability.
  • The Customer must ensure they, or an authorised representative, are present at the property at the scheduled appointment time to provide access and approve the commencement of work.
  • If the Customer is not available, and access to the property cannot be obtained, the Business reserves the right to:
  • Charge a call-out fee of $80 (to cover time, travel and scheduling costs) and/or
  • Reschedule the appointment at the next available time slot.
  • If a deposit has been paid, it may be forfeited to cover the cost of the missed appointment, at the Business’s discretion.
  • For larger or scheduled project works, extended delays caused by the Customer’s unavailability may affect timelines and may result in additional charges for rescheduling or downtime.


7. Limitation of Liability

  • The Business is not liable for any indirect, incidental, or consequential damages resulting from delay, defective materials, or workmanship unless required by law.
  • To the extent permitted by law, the Business’s total liability is limited to re-performing the service or refunding the service fee, at its discretion.

 

8. Clearing of Blocked Drain

8.1 Simply clearing the blockage does not imply that the cause of the blockage had been rectified. Issues such as faulty joints, broken pipes or foreign objects which have entered the drain can be the reason for the issue. The presence of root growth generally indicates damaged pipes. The damage cannot be rectified by simply removing the root growth or clearing the drain. For that reason, removal of root growth or the blockage alone carries no warranty that similar problems will not occur. Should the drain continue to block, the Business will recommend further investigation to determine the cause of the blockage. The Business can provide an estimation of the cost of rectification once the cause has been identified and located.
8.2 Cameras and clearing Equipment may need to be sent through poor quality drains to ascertain what is causing a blockage. The Customer agrees to indemnify the Business from any costs, losses or expenses for damage to the Business’ Equipment in the process of such investigative work.

9. Ownership of Goods

  • Goods supplied and installed remain the property of the Business until full payment has been received.
  • The Business reserves the right to remove any goods not paid for in accordance with the agreed terms.

 

10. Minimum Charge Policy

All services are subjected to a minimum charge of one hour’s labour, billed at $130 (inc gst), regardless of whether the work takes less than an hour to complete. After the first hour, additional labour will be billed in 30-minute increments at the applicable hourly rate. This minimum charge applies to all service calls, including diagnostics, inspections and minor repairs unless otherwise agreed in writing.


11. Governing Law

These Terms and Conditions are governed by the laws of the state or territory in which the services are performed. Any disputes will be handled in accordance with Australian consumer and trade laws.


12. Acceptance

By engaging the Business to provide plumbing services (via quote approval, verbal instruction, deposit payment, or other means), the Customer agrees to be bound by these Terms and Conditions.

 

Bury Plumbing Pty Ltd has the right to ament these Terms and Conditions at their discretion.
